K-1 Visas

The process of getting a K-1 Visa can seem complicated.

The Law Office of Erik Morales simplifies the Fiance(e) Visa process for clients.

Here are the requirements. Hint: you can fill out my Eligibility Inquiry form.

1. A US Citizen and a foreign citizen are engaged to be married. Don’t worry, the K-1 Visa doesn’t require that you already made wedding plans, or even bought a ring. You just need to have the intent to get married within 90 days of using the K-1 Visa to enter the US.

2. You and your fiance(e) are free to marry. Any prior marriage must be over, and you must be of legal age to marry. If you’re already married to a foreigner, see our page on K-3 Visas.

3. You and your fiance(e) must have met with each other in person at least once in the past two years. This is pretty strict–if you’ve never actually seen your fiance(e) in person, call us to discuss your options.

4. The US Citizen has to be 125% above the poverty line. This isn’t hard to meet. Check out my article on the poverty guidelines here. There are no income requirements for the foreign fiance(e).

5. The foreign fiance(e) is not inadmissible under US immigration law.

6. There are a few other factors to look at (such as whether the US citizen has previously filed a K-1 petition) that a lawyer such as myself would discuss with you during a consultation.
